These Terms and Conditions govern the use of MailReport and all related services,
websites, applications, dashboards and reports provided by MailReport.
By accessing or using MailReport, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, you should discontinue use of
the service.
MailReport provides e-mail security monitoring, reporting, alerting and visibility
services. This includes, but is not limited to, DMARC reporting, DNS monitoring,
SMTP TLS reporting, blacklist monitoring and related analytical capabilities.
MailReport is designed to assist organizations in understanding and improving their
e-mail security posture. MailReport does not guarantee the prevention of phishing,
spoofing, fraud, malware, security incidents or regulatory violations.
Customers remain responsible for their own infrastructure, DNS configuration,
e-mail systems, authentication records, security policies and compliance obligations.
MailReport provides monitoring and visibility capabilities only. Decisions regarding
remediation, configuration changes, incident response and risk management remain the
sole responsibility of the customer.
Users may not use MailReport for unlawful purposes, attempt unauthorized access to
systems, interfere with service availability, circumvent security controls or use
the platform in a manner that could negatively impact other users or the operation
of the service.
MailReport reserves the right to suspend or terminate access where misuse,
abuse or unlawful activity is suspected.
MailReport strives to provide a reliable and highly available service. However,
uninterrupted availability, continuous operation and error-free performance cannot
be guaranteed.
Scheduled maintenance, upgrades, hardware failures, connectivity issues and other
circumstances may occasionally affect service availability.
MailReport provides monitoring, reporting, alerting and visibility capabilities
related to e-mail security. MailReport is intended to assist organizations in
identifying potential risks, configuration issues and operational changes within
their e-mail ecosystem.
MailReport does not guarantee that customer environments are secure, compliant,
correctly configured, protected against malicious activity or free from
vulnerabilities. The service should not be considered a substitute for security
personnel, security controls, security assessments, incident response procedures,
audits or regulatory compliance programs.
Customers remain fully responsible for the operation, maintenance and security of
their own infrastructure, DNS records, e-mail systems, authentication mechanisms,
security policies and compliance obligations.
Where MailReport is purchased, configured, managed or operated through a reseller,
managed service provider, consultant or implementation partner, such parties remain
responsible for the services and advice they provide to the customer. MailReport is
not responsible for configuration errors, omissions, recommendations or operational
decisions made by third parties.
The customer remains solely responsible for evaluating alerts, reviewing reports,
implementing corrective actions and determining whether appropriate security
measures have been implemented within their environment.
MailReport retains all intellectual property rights related to the MailReport
platform, software, documentation, reports, designs, trademarks and related
materials.
Customers retain ownership of their own data and information submitted to the
platform. MailReport only receives the rights necessary to process this information
for the purpose of delivering the service.
To the maximum extent permitted by applicable law, MailReport shall not be liable
for indirect, incidental, consequential or special damages, including loss of data,
loss of profits, loss of revenue, loss of business opportunities, loss of reputation
or interruption of business operations.
MailReport shall not be responsible for security incidents, phishing attacks,
e-mail abuse, deliverability issues or configuration errors originating outside
of the MailReport platform.
In all cases, MailReport's total liability shall be limited to the amount paid
by the customer for the service during the twelve months immediately preceding
the event giving rise to the claim.
Customers may discontinue use of MailReport at any time. MailReport reserves the
right to suspend or terminate access where these Terms and Conditions are violated
or where continued service delivery is no longer feasible.
Termination of the service does not affect obligations that by their nature are
intended to survive termination, including intellectual property rights,
confidentiality obligations and liability limitations.
These Terms and Conditions shall be governed exclusively by the laws of
The Netherlands.
Any disputes arising from or relating to the use of MailReport shall be submitted
exclusively to the competent courts of The Netherlands.
MailReport reserves the right to modify these Terms and Conditions from time to time.
Updated versions will be published on the MailReport website and will become effective
upon publication unless stated otherwise.
Continued use of MailReport after updated Terms and Conditions have been published
constitutes acceptance of the revised terms.
